Coronavirus (COVID-19) Update – Another Lawsuit Filed Against Pritzker’s “Stay at Home” Order; Update on COVID-19 Cases

Another Lawsuit Filed Against Pritzker’s “Stay at Home” Order
: A second lawsuit has been filed this week aimed at stopping the governor’s “Stay at Home” Executive Orders which also required certain businesses, including barbershops, salons, bars, dine-in restaurants, gyms, bowling alleys, etc. to be shut down. The motion filed today in Winnebago County by State Rep. John Cabello (R-Machesney Park) on behalf of himself and every resident of the state of Illinois claims Governor Pritzker has exceeded his authority. The suit asks for a Declaratory Judgment and Injunctive Relief against not only the current “Stay at Home” order but future orders as well.  The suit further opines that it is necessary for the legislature to provide the governor any further emergency powers beyond current law’s 30-day window.

Governor Pritzker today similarly blasted this action as an irresponsible, cheap publicity stunt and will file an appeal if this particular suit is successful. As for the TRO issued against his order in Clay County this week, the Illinois Attorney General’s office has filed an appeal in both the 5th Appellate District and the Illinois Supreme Court.

If this suit is ultimately successful, it would exempt every person in the state from the governor’s order.  In addition to these two lawsuits, today Woodford County State’s Attorney announced that his office will not prosecute any violations of Governor Pritzker’s extended “Stay-at-Home” order.  CICI will keep you up to date on any further developments.
